These Terms & Conditions (“Terms”) govern your use of CreditStatusCheck.co.za (“Credit Status Check”, “the Website”, “we”, “us” or “our”), including the Credit Status Check assessment, Financial Health Score, results, tools, content and related services.

By accessing the Website or completing an assessment, you agree to these Terms.

If you do not agree with these Terms, you should not use the Website or submit your information.

1. Purpose of Credit Status Check

CreditStatusCheck.co.za provides an online financial health assessment designed to help South African consumers better understand their financial circumstances.

Based primarily on information that you provide, the Website may generate:

  • a Financial Health Score;
  • a general financial health status;
  • a Debt Danger Zone or similar indicator;
  • positive financial indicators;
  • possible factors that could affect credit applications;
  • educational information and guidance; and
  • information about financial products or services that may potentially be relevant to your circumstances.

Credit Status Check may use automated rules, algorithms and artificial intelligence (“AI”) to analyse the information you provide and generate these results.

2. Credit Status Check Is Not a Credit Bureau

CreditStatusCheck.co.za is not a credit bureau.

The Financial Health Score and other results generated by Credit Status Check are not official credit bureau scores or credit reports.

Unless we expressly state otherwise in relation to a specific service, completing a Credit Status Check assessment does not cause us to obtain your official credit score from a registered credit bureau.

The Credit Status Check assessment is based primarily on the information and answers you provide and may use automated rules, algorithms and AI to analyse that information.

The Financial Health Score should therefore not be interpreted or represented as a score issued by a registered credit bureau.

Your actual credit profile and official bureau score may differ materially from the results generated by Credit Status Check.

3. No Guarantee of Credit Approval

Your Credit Status Check results do not constitute:

  • an official credit bureau score;
  • an official credit report;
  • a credit application;
  • approval or pre-approval for credit;
  • a guarantee of credit approval;
  • a guarantee that an application will be declined;
  • financial advice; or
  • a legally binding lending decision.

Banks, lenders, credit providers and other financial institutions use their own credit policies, affordability assessments, credit bureau information, scoring systems and eligibility criteria.

A person receiving a positive Credit Status Check result may still be declined for credit.

Similarly, a person receiving a poor or below-average Credit Status Check result may still qualify for certain financial products.

Credit Status Check cannot guarantee how any third party will assess your circumstances.

4. AI and Automated Assessment

You acknowledge that Credit Status Check uses automated processing and may use artificial intelligence, algorithms, calculations and predefined assessment rules to generate personalised results.

These systems may consider information such as:

  • income;
  • employment status;
  • debt levels;
  • arrears;
  • affordability;
  • debt review status;
  • dependants;
  • housing circumstances;
  • banking status; and
  • other information submitted during your assessment.

The resulting assessment represents an estimate based on the information available to our systems at the time.

AI-generated or automated information may occasionally be incomplete, inaccurate or inappropriate for a user’s particular circumstances.

You should therefore use the results as an informational guide rather than relying on them as a definitive assessment of your creditworthiness or financial position.

5. Information You Provide

The accuracy and usefulness of your assessment depend substantially on the accuracy of the information you provide.

By using Credit Status Check, you agree to:

  • provide information that is accurate and complete to the best of your knowledge
  • provide only your own personal information, unless you have lawful authority to provide information on behalf of another person;
  • update or correct information where appropriate;
  • use the Website only for lawful purposes; and
  • not intentionally provide false, misleading or fraudulent information.

If information supplied by you is incorrect, incomplete or outdated, your Credit Status Check results may also be inaccurate.

6. Age Requirement

Credit Status Check is intended for persons aged 18 years or older.

By completing an assessment, you confirm that you are at least 18 years old and legally capable of using the services provided through the Website.

7. Your Assessment Results and Tokenised Link

After completing an assessment, we may generate a unique, tokenised link allowing you to access your personalised Credit Status Check results.

This link is intended for your personal use.

You should keep the link private and should not forward or share it with anyone whom you do not want to have access to your assessment.

Anyone who obtains the tokenised link may potentially be able to access the assessment associated with it while the token remains valid.

For privacy and security purposes, the tokenised results link expires 4 days after completion of the assessment.

Once the token expires, the link will no longer provide access to those assessment results.

Expiry of the token does not necessarily mean that all underlying personal information associated with the assessment has been deleted. Information may be retained in accordance with our Privacy Policy and applicable law.

8. Financial Information and Guidance

Information provided through Credit Status Check is intended for general informational and educational purposes.

Nothing on the Website should be regarded as personalised financial, legal, tax, investment or credit advice.

Where your circumstances require professional advice, you should consult an appropriately qualified or registered professional.

You remain responsible for financial decisions you make after using the Website.

9. Financial Products and Services

Credit Status Check may identify financial products or services that appear potentially relevant to you based on information you provide.

These may include services or products such as:

  • personal loans;
  • debt assistance;
  • insurance;
  • home finance;
  • financial wellness services; and
  • other financial products or services.

The display of a product or service does not mean that you have been approved or pre-approved for it.

It also does not mean that the product is necessarily the best or only option available to you.

10. Third-Party Providers

Credit Status Check does not necessarily provide the financial products displayed or referred to on the Website.

Products and services may be provided by independent third-party lenders, insurers, financial service providers, intermediaries, debt assistance providers or other businesses.

If you choose to request a product, quotation, assessment or service from a third-party provider, that provider may:

  • perform its own eligibility assessment;
  • request additional information;
  • conduct affordability or verification checks;
  • request additional consent;
  • access credit bureau information where lawfully permitted and where the required authority or consent has been obtained;
  • apply its own terms and conditions; and
  • approve or decline your application or enquiry independently of Credit Status Check.

You should review the third party’s terms, privacy policy, fees, interest rates, exclusions and other relevant information before accepting a product or service.

11. Consent to Share Information for a Requested Service

Where you actively select, request or express interest in a particular third-party product or service, you authorise us to provide the information reasonably necessary to facilitate that request to the relevant provider, intermediary or authorised partner.

The information shared may include relevant:

  • identification information;
  • contact details;
  • employment information;
  • income information;
  • financial circumstances;
  • assessment information; and
  • other information reasonably required to process the service you requested.

The relevant provider may contact you regarding that specific enquiry or request.

Submitting a Credit Status Check assessment by itself does not mean that every financial service provider or partner is authorised to perform a credit bureau enquiry on you.

Where a particular service requires an official credit bureau enquiry or additional consent, the appropriate consent or authority should be obtained for that service.

12. Debt Assistance

Your assessment may indicate that debt assistance, debt counselling or another financial wellness service could potentially be relevant to your circumstances.

Being shown information about debt assistance does not mean:

  • that you are under debt review;
  • that you have applied for debt review;
  • that you have entered debt counselling;
  • that you are obliged to use a debt assistance service; or
  • that a debt counsellor has made a formal assessment of your circumstances.

If you choose to request a debt assessment or related service, your information may be provided to an appropriately authorised third-party provider for that purpose.

That provider may require additional consent and information before performing its assessment or obtaining consumer credit information.

Any estimated repayment reduction, saving, affordability improvement or other benefit displayed before a formal assessment is indicative only and is not guaranteed.

13. Marketing Communications

Where required by applicable law, marketing communications will be sent only where the appropriate consent or other lawful basis exists.

Where you separately consent to receive marketing communications, we may send information about financial products, services, offers and related information that may be relevant to you.

These communications may be delivered through channels such as email or SMS.

You may withdraw your marketing consent or unsubscribe at any time using the method provided in the communication or by contacting us.

Withdrawing marketing consent does not prevent us from sending legitimate service communications relating to an assessment or service that you specifically requested.

14. Service Communications

By requesting and completing a Credit Status Check assessment, you acknowledge that we may need to communicate with you in order to provide that service.

Service communications may include:

  • confirmation of your assessment;
  • delivery of your assessment results;
  • a link to access your results;
  • reminders relating to the availability or expiry of your results;
  • security or technical notifications; and
  • responses to enquiries you submit.

These communications are related to providing the service you requested and are separate from general promotional marketing.

15. No Guarantee Regarding Assessment Accuracy

We take reasonable steps to make Credit Status Check useful and informative, but we do not warrant that every assessment, calculation, explanation, recommendation or AI-generated result will be complete or error-free.

Results may be affected by:

  • inaccurate information supplied by you;
  • incomplete information;
  • changes in your circumstances;
  • limitations in automated assessment models;
  • assumptions used in calculations;
  • technical errors; or
  • differences between our methodology and the methods used by lenders, credit bureaus or other third parties.

You should not rely on the Credit Status Check assessment as the sole basis for an important financial decision.

16. Privacy and POPIA

We process personal information in accordance with applicable South African data protection requirements, including the Protection of Personal Information Act 4 of 2013 (“POPIA”).

Our Privacy Policy explains in more detail:

  • what information we collect;
  • how it is used;
  • AI and automated processing;
  • how information may be shared;
  • data retention;
  • tokenised assessment links;
  • marketing consent;
  • security measures; and
  • your privacy rights.

By using the Website, you acknowledge that your personal information will be processed as described in our Privacy Policy and these Terms.

17. Website Availability

We aim to keep CreditStatusCheck.co.za and its assessment services available and functioning correctly.

However, we do not guarantee uninterrupted or error-free access.

The Website or certain features may occasionally be unavailable due to:

  • maintenance;
  • hosting problems;
  • software updates;
  • third-party service interruptions;
  • internet connectivity;
  • security incidents;
  • technical failures; or
  • circumstances beyond our reasonable control.

We may modify, suspend or discontinue parts of the Website or assessment service where reasonably necessary.

18. Prohibited Use

You may not:

  • use the Website for unlawful or fraudulent purposes;
  • submit another person’s personal information without lawful authority;

  • reproduce or commercially exploit our assessment methodology, content or technology without permission.

19. Intellectual Property

Unless otherwise stated, the content and intellectual property associated with CreditStatusCheck.co.za belong to Service Driven Digital (Pty) Ltd or are used under appropriate licence.

This includes, where applicable:

  • branding;
  • logos;
  • written content;
  • Website design;
  • assessment methodology;
  • Financial Health Score presentation;
  • graphics;
  • software;
  • calculations;
  • database structures; and
  • other proprietary technology or content.

You may use your own assessment results for personal purposes.

You may not copy, reproduce, republish, distribute, reverse engineer or commercially exploit our Website, content, assessment methodology or technology without prior written permission.

20. Third-Party Links

CreditStatusCheck.co.za may contain links to websites operated by third parties.

We do not control those websites and are not responsible for their availability, security, content, products, privacy practices or terms.

Following a third-party link is at your discretion.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Service Driven Digital (Pty) Ltd, its directors, employees, contractors and affiliates will not be liable for losses or damages arising solely from:

  • reliance on an indicative Credit Status Check assessment;
  • differences between your Credit Status Check result and an official credit bureau score;
  • a lender or provider approving or declining an application;
  • decisions made by independent third-party providers;
  • inaccurate or incomplete information supplied by you;
  • temporary interruption of the Website;
  • expiry of a tokenised assessment link;
  • unauthorised access resulting from you sharing or failing to protect your assessment link; or
  • third-party websites, products or services.

Nothing in these Terms is intended to exclude or limit liability where such liability cannot lawfully be excluded or limited under South African law.

22. No Waiver of Consumer Rights

Nothing in these Terms is intended to remove, restrict or waive any rights that you have under applicable South African consumer, privacy, credit or other legislation where those rights cannot legally be excluded.

If any provision of these Terms conflicts with a mandatory provision of applicable law, the applicable law will prevail to the extent of that conflict.

23. Changes to the Assessment

We may modify the Credit Status Check assessment, scoring methodology, questions, algorithms, AI systems, product eligibility rules, presentation or other features from time to time.

As a result, assessments performed at different times may produce different results even where some information remains the same.

A previous assessment should not be assumed to represent your current financial circumstances.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, technology, business practices or applicable requirements.

The latest version will be published on CreditStatusCheck.co.za with an updated effective date.

Your continued use of the Website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

25. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.

26. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute relating to the Website or these Terms will be dealt with in accordance with applicable South African law and through the courts or other dispute-resolution mechanisms having jurisdiction.

Your results are intended to help you understand aspects of your financial circumstances. They are not an official credit bureau score, official credit report, financial advice, credit decision or guarantee of approval.

Your actual credit profile and the assessment made by a lender, credit provider, credit bureau or other financial institution may differ from the results displayed by Credit Status Check.
